The Additional District Consumer Disputes Redressal Commission-III, Bengaluru Urban (Karnataka), chaired by Shivarama K as President and Rekha Sayannavar as Member, found Union Bank of India accountable for failing to reimburse funds erroneously debited from the complainant’s bank account during an ATM withdrawal attempt.
Key Details
The complainant tried to withdraw Rs. 5,000/- and Rs. 3,000/- from a Union Bank of India ATM by inserting his card twice. However, no cash was dispensed despite the deductions from his savings account. Despite multiple email exchanges with the bank, the complainant did not receive a satisfactory resolution.
Feeling aggrieved, the complainant approached the III Additional Bangalore Urban District Consumer Disputes Redressal Commission and lodged a consumer complaint against the bank. The bank did not attend the proceedings before the District Commission.
Findings by the District Commission
After reviewing a photocopy of the bank statement, the District Commission observed that on April 26, 2023, sums of Rs. 5,000/- and Rs. 3,000/- were debited from the complainant’s account. The bench further noted that the bank did not contest this oral and documentary evidence. Consequently, the District Commission determined that the bank was at fault.
As a result, the District Commission instructed the bank to repay the complainant Rs. 8,000/- along with an annual interest rate of 9%. Additionally, the bank was directed to provide Rs. 3,000/- as compensation for mental distress and litigation expenses.
