Mumbai: MahaRERA Directs Promoters of Rustomjee Crown to Pay Interest Due to Delayed Possession

According to the complaint, Anil Dattani entered into a registered agreement for sale on January 25, 2019. The developer had promised to deliver possession of the flat by December 2021.

Mumbai: MAHA RERA has reprimanded the owners of Rustomjee Crown Phase One, a Prabhadevi-based project, directing the project promoter to compensate the complainant with monthly interest for the delayed possession until the actual handover of the flat.

According to the complaint, Anil Dattani signed a registered agreement for sale on January 25, 2019, with the developer committing to deliver possession of the flat by December 2021.

The project developers contested the complainant’s claims, citing reasons for the delay such as changes in fire NOC norms, delays in obtaining operating and establishment consents, and new pollution control norms issued by MCGM in November 2023 regarding flat modifications, which they have since agreed to.

Advocate Nilesh Gala, representing Dattani, stated, ‘Initially, MahaRERA refused to acknowledge the consent terms. Subsequently, the Bombay High Court intervened, leading to the current order by MahaRERA member Mr. Pathak. However, full compliance with the consent terms has not yet been achieved. The society has not been formed, and the developers have yet to commence construction of amenities. Our clients expected not just four walls but a residence with world-class amenities, which remains a distant prospect.
