Bangalore District Commission Finds Cashify Responsible for Selling Defective Mobile Phone and Breaching Warranty Terms

The Additional District Consumer Disputes Redressal Commission-II, Bangalore Urban, with Vijaykumar M Pawale (President), V Anuradha (Member), and Renukadevi Deshpande (Member) presiding, has found Cashify liable for deficiencies in service and unfair trade practices. The commission determined that Cashify sold a defective mobile phone and failed to either replace it or provide a refund, despite the device being under warranty.

Case Summary:

The complainant purchased a refurbished Samsung Galaxy Z Flip-4 from Cashify for ₹60,614.05. Cashify offered a six-month warranty, promising to replace the device if any issues arose and to address minor problems within 24 hours. However, within three months, the complainant encountered problems with the phone not opening properly. After visiting the Cashify showroom, Cashify picked up the phone, obtained the complainant’s signature on a pick-up form, and acknowledged the issue. Despite this, Cashify only provided a temporary fix and returned the defective phone.

The complainant returned to the showroom for further repair, and Cashify assured that if the problem persisted, the device would be replaced. Despite these assurances, the phone remained unresolved and no replacement was offered. Upset by the lack of resolution, the complainant filed a complaint with the Additional District Consumer Disputes Redressal Commission-II, Bangalore Urban.

Commission’s Observations:

The commission found that Cashify failed to either replace the defective phone or refund the amount paid. The mobile phone, as delivered, did not serve its intended purpose. Consequently, Cashify was held accountable for deficiencies in service and unfair trade practices.

The commission ordered Cashify to either replace the defective phone with a new Samsung Galaxy Z Flip4 or refund ₹60,615, including interest at 6% per annum until the amount is paid. Additionally, Cashify was directed to compensate the complainant with ₹3,000 for litigation expenses.
